Introduction
Mr. Ignasius Jonan, the Minister of Energy and Mineral Resources of Republic Indonesia enacted a new regulation on May 9th 2017, namely Energy and Mineral Resources Minister Regulation Number 34 Year 2017 concerning Licensing in the Field of Mineral and Coal Mining (“ESDM Reg. 34/2017”). Under one of the ESDM Reg. 34/2017 considerations, it is stated that in order to encourage the development of business, to guarantee legal and business certainty, and to improve the effectivity of licenses issuance in the field of mineral and coal mining, there is a necessity to simplified the licensing in the field of mineral and coal mining. For this particular consideration, the ESDM Reg. 34/2017 was enacted in order to improve the administration of licensing to become easier, faster, and cheaper.
